New York has one of the oldest and most layered bodies of gambling law in the United States. Gambling was originally prohibited by the state constitution, and every legal form of wagering today exists because voters or lawmakers carved out a specific exception. Understanding that structure explains why sports betting is legal but online casino is not.
Who regulates gambling in New York?
The New York State Gaming Commission (NYSGC) is the primary regulator. It oversees commercial and tribal casinos, video-lottery facilities, the state lottery, pari-mutuel horse racing, charitable gaming and — since 2022 — mobile sports betting. Any legal online casino would fall under the Commission too, but because iGaming has not been authorized, there is nothing for it to license.

Why sports betting is legal but online casino is not
The two were authorized on completely different tracks. Sports betting became possible after the US Supreme Court struck down the federal PASPA ban in 2018; New York already had enabling language from a 2013 casino amendment and used it to authorize retail sportsbooks, then passed mobile sports betting in the 2021 budget. The 2013 casino expansion
In 2013, New York voters approved a constitutional amendment authorizing up to seven Las Vegas-style commercial casinos. Four upstate properties opened first; the remaining three "downstate" licenses were awarded in December 2025 to projects in the Bronx, Queens and at Resorts World in Queens. This build-out is one reason legislators have been cautious about online casino — they want the new physical venues established first.
Where offshore sites fit in
Because there is no regulated online casino, some New Yorkers use offshore operators licensed in jurisdictions such as Panama and Curaçao. These are not illegal for a player to access in practice, but they are unregulated by New York and sit in a grey area.
